By creating a Spoto account or using joinspoto.com (the "Service"), you agree to these Terms. If you are agreeing on behalf of a business, you represent that you have authority to bind that business. If you do not agree, do not use the Service.
Spoto is a gym management platform providing tools for memberships, scheduling, check-ins, payments, staff management, communications, and reporting. Each Gym Operator's data is stored in a dedicated, isolated database. Payment processing is handled by Stripe through Stripe Connect.
You must provide accurate information when creating an account. You are responsible for safeguarding your credentials and all activity under your account. Notify us immediately at support@joinspoto.com if you suspect unauthorized access.

$8 CAD/month billed monthly. All prices in Canadian dollars, plus applicable GST/HST. 30 days' notice before price increases.
Processed through Stripe Connect, flowing directly to the Gym Operator's Stripe account. Spoto collects an application fee per transaction. Stripe's terms apply. Spoto is not responsible for payment disputes between Gym Operators and members.
Subscription fees are non-refundable for partial months. If we discontinue the Service, we provide 90 days' notice and a pro-rated refund.
All member records, transactions, schedules, and data you create belongs to you. Spoto has a limited license to process it solely to provide the Service.
You can export your complete data at any time in CSV format, at no cost. Upon termination, we retain data for 90 days for export before permanent deletion.
We believe you should never be locked into a platform. Free data portability is a core commitment, not an add-on.
The Service, including its software, design, and branding, is owned by Spoto Technologies Ltd. You retain all rights to content you upload. By uploading, you grant Spoto a limited license to store and display it to provide the Service.
We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance communicated in advance. Support via support@joinspoto.com with one business day response target.
Spoto's total liability is limited to the amount you paid in the 12 months preceding the claim. Spoto is not liable for indirect, incidental, special, or consequential damages. Spoto is not liable for Gym Operator actions, Stripe payment failures, user-entered data accuracy, or force majeure. Nothing excludes liability for fraud, gross negligence, or death/injury from negligence.
Cancel anytime. Access continues through end of billing period. 90 days to export data.
We may terminate for Terms violations, non-payment after 30 days, or security threats. 14 days' written notice except for serious violations. 90 days data export access provided.
Governed by Alberta law and federal Canadian law. Courts of Calgary, Alberta have exclusive jurisdiction. Both parties agree to 30 days good-faith negotiation before legal proceedings.
These Terms plus our Privacy Policy constitute the full agreement. Amendments with 30 days' notice. Severability applies. You may not assign without consent. Our failure to enforce does not waive rights.
